Welcome to TindaTap (the "App"), a mobile application developed by Abakus Dev ("we," "us," or "our"). By downloading, installing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the App.
1. Scope of Service
TindaTap is a digital utility tool designed strictly for manual calculation, digital catalog organization, and internal sales tracking. The App acts as a digital notebook and visual calculator to help users compute order totals and maintain internal logs of their manually entered transactions.
2. Strict Tax & Legal Compliance Disclaimer
- No Receipt Generation: The App does not generate official receipts, invoices, or electronic invoices as recognized by the BIR[cite: 12, 23, 223].
- User Receipt Obligations: In accordance with Philippine revenue regulations (including RR No. 11-2025), users who are registered taxpayers are legally required to issue official, BIR-registered manual invoices or utilize a separate compliant electronic invoicing system alongside this App[cite: 204, 270].
- No Tax Reporting: The App does not automatically transmit data to the Electronic Sales Reporting (eSales) System or any government platform[cite: 187, 223].
- Permit to Use (PTU) Warning: Depending on your business classification and how your local Revenue District Office (RDO) interprets the law, utilizing a digital ordering or catalog tool may require the user to independently register it as a Special Purpose Machine (SPM) to secure a Permit to Use (PTU)[cite: 14, 23]. Compliance with local registration rules is entirely the user's responsibility[cite: 14].
3. User Responsibilities & Accurate Recording
- Manual Data Entry: The App relies completely on the information you manually input. We have no control over, and accept no liability for, the accuracy, completeness, or lawfulness of the data you input.
- No Sales Suppression: You explicitly agree not to use the App for illegal purposes, including but not limited to, intentional tax evasion, sales suppression, or maintaining fraudulent parallel financial records[cite: 152].
- Compliance with the Law: You bear sole legal liability for reporting your true sales, paying correct taxes, and fulfilling all statutory business requirements under the National Internal Revenue Code and related guidelines[cite: 126, 156].
4. Limitation of Liability
To the maximum extent permitted by applicable law, TindaTap and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to:
- Any tax penalties, audits, fines, or legal sanctions imposed on you by the BIR or any regulatory body due to improper bookkeeping or receipt issuance[cite: 126, 272].
- Loss of data, profits, business interruptions, or device malfunctions resulting from your use of the App.
- Disallowance of your business expenses or tax claims by authorities due to a lack of valid, compliant receipts[cite: 126].
5. Data Privacy & Backups
- Local Storage: Your data is stored locally on your device unless otherwise specified by optional cloud-sync features. It is your sole responsibility to back up your device and sales histories. We are not responsible for data lost due to app uninstallation, device damage, or factory resets.
- Privacy Policy: Your use of the App is also governed by our Privacy Policy, available at tindatap.com/privacy/.
6. Changes to the App and Terms
We reserve the right to modify, update, or discontinue any feature within the App (including sales summaries) or update these Terms and Conditions at any time without prior notice. Your continued use of the App following any changes constitutes your binding acceptance of the updated terms.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any legal actions or disputes arising from the use of this App shall be handled exclusively in the proper courts of the Philippines.
